By accessing or using the Odapp platform (getodapp.com), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use Odapp. Your employer or workspace administrator may have additional terms that apply to your use.
Odapp is an SMS-first operations management platform designed for restaurants and sports facilities. The platform allows managers to create and manage staff schedules, send work-related notifications via SMS, track staff availability, and manage operational tasks. Staff members receive SMS communications related to their schedules and work assignments.
Consent to SMS: By registering for Odapp or providing your phone number to your employer through Odapp, you affirmatively consent to receive recurring SMS text messages including work schedule information and changes, shift reminders, availability requests and callout notifications, and administrative communications related to your employment or work assignment.
SMS Frequency and Timing: SMS messages may be sent at any time, including evenings and weekends. Frequency depends on your work schedule and operational needs. Standard message and data rates may apply per your wireless carrier.
Opt-Out: You can opt out at any time by replying STOP to any SMS message. Opting out may affect your ability to receive important work-related communications.
SMS Consent Disclaimer: You acknowledge that you are the rightful owner/subscriber of the phone number you provide, you have the authority to provide this number for SMS communications, you understand carrier rates and charges may apply, and SMS is your preferred method of communication for work-related matters.
Odapp grants you a limited, non-exclusive, non-transferable license to access and use the platform solely for authorized work-related purposes. You may not reproduce, duplicate, or copy content without permission, use the platform for unlawful purposes, attempt to gain unauthorized access, transmit harmful code or malware, interfere with platform operation, or use the platform for personal profit or commercial purposes (unless authorized).
You agree not to use Odapp to violate any applicable laws or regulations, harass, threaten, or defame any person, send spam or unsolicited communications, impersonate others or misrepresent affiliation, infringe on intellectual property rights, or collect or track personal information without consent.
You are responsible for maintaining the confidentiality of your login credentials, all activity that occurs under your account, notifying us immediately of unauthorized access, providing accurate and current information, and keeping your phone number current if using SMS features.
TO THE FULLEST EXTENT PERMITTED BY LAW: Odapp is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, special, consequential, or punitive damages; loss of data, revenue, profits, or business opportunity; failure or delay of SMS messages; errors or omissions in content; unauthorized access to your information; or third-party actions or conduct. Our total liability shall not exceed the amount you paid for the service in the past 12 months, or $100, whichever is less.
You agree to indemnify and hold harmless Odapp, its owners, managers, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from your violation of these Terms, your use of Odapp, your infringement of third-party rights, or any content you provide or transmit.
You agree to keep any information shared through Odapp confidential and not to disclose it without authorization.
All content, features, and functionality of Odapp (including but not limited to logo, design, text, graphics, and software) are the exclusive property of Odapp or its licensors. You may not reproduce, distribute, or transmit any content without permission.
Odapp may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of external sites. Your use of third-party services is subject to their terms and privacy policies.
We may terminate or suspend your access to Odapp immediately, without notice, for violation of these Terms, illegal or harmful activity, non-payment (if applicable), or inactivity or other legitimate business reasons. Upon termination, your right to use Odapp ceases immediately.
Governing Law: These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.
Arbitration: Any dispute arising from these Terms shall be resolved through binding arbitration administered by JAMS in Denver, Colorado. You waive the right to pursue claims in court (except for injunctive relief).
Exceptions: The following do not require arbitration: small claims court actions, requests for injunctive relief, and claims for intellectual property infringement.
We may modify these Terms at any time. Material changes will be announced via SMS or email (if you're registered). Continued use of Odapp after modifications constitutes acceptance of updated terms.
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Odapp regarding your use of the platform.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.
